Does Your Divorce Qualify as Uncontested?

If you and your spouse both agree to end the marriage and have resolved all related issues, your divorce is uncontested — sometimes called a simple, joint, or mutual divorce. This is the most common and most affordable type of divorce in BC.
Your divorce qualifies as uncontested if:
  • You and your spouse both agree to the divorce
  • You have been separated for at least one year
  • There are no children, OR all parenting, child support, and property matters are already resolved through a written agreement, consent order, or mediated settlement
  • Neither spouse is contesting any terms
If any of these conditions are not met — for example, if parenting arrangements or property division are still in dispute — your matter is contested and will require a different approach. Call us to discuss your situation.
Note: Under the BC Family Law Act, “children” includes any child under 19, or any child 19 or older who is a full-time student or otherwise dependent. If you have a child who meets this definition, the $3,000 fee applies.

BC Legal Requirements for an Uncontested Divorce

To obtain a divorce in British Columbia:
  • You or your spouse must have been a resident of BC for at least one year before filing
  • You must have been separated for at least one year (separation does not require a court order — it begins when you or your spouse intend to end the marriage)
  • The divorce is filed in BC Supreme Court — no court appearance is required for an uncontested divorce (desk order divorce)
  • If children are involved, satisfactory parenting and child support arrangements must be in place before the divorce order is granted
