What Does a Cohabitation Agreement Cover?

A cohabitation agreement is a legal contract between two people who are living together — or planning to — without getting married. It sets out how property, assets, and debts will be handled if the relationship ends.
In BC, common-law couples do not have the same automatic property rights as married spouses. Without a cohabitation agreement, you may have little legal protection over assets you brought into the relationship or acquired together.
A cohabitation agreement is worth considering if:
  • You are moving in together and each have assets or debts
  • One or both partners own real estate
  • You have children from a previous relationship
  • You want to protect an inheritance or family assets
  • You want clarity and fewer disputes if things change
In BC, cohabitation agreements are governed by the Family Law Act and must meet specific legal requirements to be enforceable.
Also covers — Marriage Agreements: A marriage agreement serves the same purpose but is signed by couples who are already married. Same fixed fee: $1,500 + tax.

BC Legal Requirements for a Valid Cohabitation Agreement

To be enforceable in British Columbia, a cohabitation agreement must:
  • Be signed voluntarily by both parties — no pressure or duress
  • Include full financial disclosure from both parties
  • Be witnessed at the time of signing
  • Each party should have independent legal advice — the other party will need their own lawyer
Note: Cube Law represents one party only. The other party will need to retain their own lawyer before signing. Electronic signatures are not accepted — in-person signing is required.

Frequently Asked Questions

Each party should have independent legal advice from their own lawyer. Cube Law represents one party only. The other party will need to retain separate counsel before signing.
No. BC law requires wet (physical) signatures witnessed in person. Electronic signatures are not accepted for this type of agreement.
A cohabitation agreement is for couples living together without being married. A marriage agreement serves the same purpose but is signed by married couples. Both are governed by the BC Family Law Act. The fixed fee is the same for both: $1,500 + tax.
In BC, common-law spouses do not have the same automatic property division rights as married spouses under the Family Law Act. Without a cohabitation agreement, there may be little legal protection over property one partner owned before the relationship or acquired during it. An agreement removes that uncertainty.
Typically 2–3 weeks from the time we receive your instructions to final signing, depending on how quickly both parties are ready.
