wills & estate planning lawyer

Looking for a wills and estate planning lawyer in Surrey BC? Cube Law Corporation helps individuals and couples prepare legally sound Wills, Powers of Attorney, and Representation Agreements. Fixed-fee packages mean you know exactly what you’re paying before your appointment — no hourly billing surprises.

Why Every Adult in BC Needs an Estate Plan

Estate planning is not just about what happens after you pass away — it protects you and your family while you are still alive.

Without a Will, BC law decides who receives your assets — which may not reflect your wishes. Without a Power of Attorney, no one has legal authority to manage your finances if you become incapacitated. Without a Representation Agreement, no one can legally make health care decisions on your behalf.

Most clients complete their entire estate plan in a single appointment at our South Surrey office. The process is straightforward — and the peace of mind it provides is permanent.

Pricing: Transparent, Fixed-Fee Wills & Estate Planning Packages

Our most popular option is the couple’s package — two complete estate plans for $1,300 (Essential) or $1,800 (Enhanced) + tax. Individual packages start at $900 (Essential) or $1,200 (Enhanced) + tax.

All packages include legal fees and applicable taxes. Prices shown are minimums — additional time billed at $300/hour + tax if required, and you will be advised before proceeding. Quote valid 30 days

What Each Estate Planning Document Does

Last Will & Testament

Your Will sets out who receives your assets, who manages your estate as executor, and — if you have minor children — who becomes their guardian. Without a Will, BC law under WESA determines these matters for you, which may not reflect your wishes.

Enduring Power of Attorney

Authorizes a trusted person to manage your financial and legal affairs if you become unable to do so. "Enduring" means it remains valid even if you lose mental capacity. Without one, your family may need to apply to court — a costly and time-consuming process.

Representation Agreement (Sections 7 & 9)

Authorizes a trusted person to make health care and personal care decisions on your behalf if you are unable to. Section 9 authority includes decisions about life support and resuscitation. The Rep Agreement covers different areas than a POA — both are strongly recommended.

DNR / Living Will / Natural Death Directive

Records your personal wishes regarding end-of-life care for health care providers. May be required for hospice or palliative care admission. Included as standard in both packages — most clients don't realize how important this document is until they need it.

Nomination of Committee (Enhanced only)

Under the Patients Property Act, this document records your preferred appointee if the BC Supreme Court ever needs to appoint a committee to manage your affairs. Not legally binding but carries significant weight with the court.

Estate Planning for Business Owners & Complex Estates

If you own a business, hold real estate, or have a complex asset structure, your estate plan requires more than a standard Will and POA. Cube Law can assist with:

  • Business succession planning — ensuring your business continues or is transferred according to your wishes (link to business law page)

  • Spousal trusts — protecting assets for a surviving spouse while preserving inheritance for children

  • Henson trusts — protecting beneficiaries with disabilities without affecting government benefits

  • Estate freeze — locking in the current value of your estate for tax purposes while transferring future growth to the next generation

  • Joint ownership and trust declarations — clarifying ownership of jointly held assets

These services are quoted individually following an initial one-hour consultation at $300 + tax. We work alongside your accountant and financial planner throughout the process.

Frequently Asked Questions

No, but a lawyer-prepared Will is far less likely to be challenged or found invalid. DIY Wills are the most common source of estate disputes and often cost families far more to fix than the original legal fees would have been.

Essential covers standard estate planning — a straightforward Will, POA, and Representation Agreement. Enhanced adds staged distributions, spendthrift trust provisions for vulnerable beneficiaries, digital asset authority, joint attorney options, and Nomination of Committee. Enhanced is recommended if you own property, have minor children, a blended family, or a business.

Your estate is distributed according to BC’s Wills, Estates and Succession Act (WESA). If you have a spouse and children, the spouse receives a preferential share ($300,000) and the remainder is split. Without a Will, you have no say in who manages your estate or who cares for your minor children.

Essential appointments typically take 60–90 minutes. Enhanced appointments may take longer or two appointments depending on the complexity of your instructions.

All prices are plus applicable taxes (GST/PST). Package price includes all legal fees and document preparation. Wills registration, if requested, is additional and charged at $75 per will.

We do not provide tax advice. Clients with complex tax situations are advised to consult an accountant or tax professional. We are happy to work alongside your existing advisors.

Yes — if you are an executor dealing with an estate, visit our probate lawyer page to learn about our Grant of Probate and Grant of Administration services.

Standalone documents are available — contact us for pricing. We strongly recommend completing your full estate plan together, as the Will, POA, and Representation Agreement cover different areas of your life and work best as a complete set.

Yes — spousal trusts, Henson trusts, and business succession planning are available and quoted following an initial consultation at $300 + tax per hour.
