Overview
Legal help with probate and estates
When someone dies in British Columbia owning assets in their own name, a bank, an investment firm or the Land Title Office will usually ask for a court grant before it releases or transfers them. We help executors and family members obtain that grant from the BC Supreme Court, from our Surrey office, and we explain each step as it comes.
This section covers three things. A Grant of Probate is for an estate where the person left a Will. A Grant of Administration is for an estate with no Will, or where the person named in the Will cannot act. Resealing is for a grant issued outside British Columbia that must be recognized here. We can prepare and file all three applications for you wherever you live, as long as the estate is being dealt with in BC.
Each page below explains what the work involves, what we need from you and what you will need to decide. Not every estate needs a grant, for example where assets pass to a surviving joint owner or to a named beneficiary. If you are not sure where yours fits, contact our office and we will tell you which page applies.
What We Handle
How We Can Help
01
Grant Of Probate
For executors named in a Will. We prepare the court application, give the required notices and file it with the BC Supreme Court to obtain the Grant.
02
Grant Of Administration
For families where there is no Will, or the executor named in the Will cannot act. We help the person entitled to apply to be appointed administrator.
03
Resealing Of A Foreign Grant
For estates where a grant was issued outside BC and the person owned assets here. We prepare the application to have the BC Supreme Court reseal it.
04
Checklist For Executors Or Administrators
A step-by-step guide for executors and administrators, from the first days after a death to closing the estate.
Why Cube Law
We handle the legal side so you can focus on what’s next.
We prepare the court application
We draft the Supreme Court forms, the affidavits and the list of assets and debts from the documents you send us, and we check them before we file.
A fixed fee for the Grant
For a usual uncontested application we quote a fixed legal fee for obtaining the Grant. Court fees and other third-party costs are separate, and we explain them in your quote.
You know who does what
Obtaining the Grant is one stage of an estate. We tell you where our fixed-fee work ends and what you will handle as executor or administrator, so nothing is missed after the Grant is issued.
Handled wherever you live
If the estate is being dealt with in BC, you do not have to live here. We work by email, courier and secure online identity verification, and we update you at each stage until the Grant is issued.

Common Questions
Frequently Asked Questions
How do I book a consultation?
Contact our office or use the contact form and we will arrange a time. Tell us whether there is a Will and roughly what the estate includes, so we can prepare. If a consultation fee applies to your matter, we will tell you before you book. We can arrange the appointment in person at our Surrey office or by other means if you live outside the area.
How do your fees work for probate?
For a usual uncontested application we quote a fixed legal fee for obtaining the Grant. Court fees, the government probate fee and other third-party costs are separate and paid at actual cost. Work after the Grant, such as selling assets or distributing the estate, is quoted separately. Starting fees are available on request.
Does every estate in BC need a grant?
No. A grant is usually needed when the person owned assets in their own name, such as a home or bank accounts, and the institution holding them asks for one. Assets that pass to a surviving joint owner or a named beneficiary often do not need it. Contact our office and we will tell you whether yours does.
How long does it take to get a Grant in BC?
For an uncontested application, obtaining the Grant typically takes three to six months, and sometimes longer. The time depends on how complete your documents are and on the court’s processing times. We cannot control the court’s timing, but we keep you updated at each stage until the Grant is issued.
What is the difference between a Grant of Probate and a Grant of Administration?
A Grant of Probate is issued when the person left a valid Will naming an executor. A Grant of Administration is issued when there is no Will, or when the executor named cannot or will not act. Both come from the BC Supreme Court and give the person appointed authority to deal with the estate’s assets.
Do you help after the Grant is issued?
Yes. Selling assets, distributing the estate and preparing estate accounts are separate from obtaining the Grant and are quoted separately. Contact our office for an estimate once the Grant is issued, or sooner if you want to plan ahead. Many executors manage some of these steps themselves, and we can help with the rest.
